My FI and I both live in North Carolina now, but we are getting married in New Jersey. Does anybody know which State it is we are supposed to apply for a marriage license? Is it the state you reside in or the state you are getting married in. This may be a dumb question but I though I would ask. We still have 2 months to the big day, but don''t want to leave this detail until the last minute!

Thanks!

Actually, it''s more specific - it has to be in the COUNTY you''ll be married in.

JCJD is right...it has to be the county within the state where you will be married. Most counties have waiting periods and expiration periods for your license. Most of the time the places where you get the license are only open during the week too so make sure to check that out ahead of time.

My husband and I had to make a special trip to our ceremony site several weeks before the wedding to just to get the license. It expired 2 days after we got married. We were cutting it close but we got it done.

On another note--make sure your officiant is licensed in the county too or else your marriage won''t be legal....

Not always true!!!

The rules for getting a license varies state by state. Here in Virginia you can get your license anywhere in the state and get married anywhere in the state. FI and I just did it that way.

http://www.state.nj.us/wedlic.html and below is what the link says...

How to Obtain a Marriage License in New Jersey:

Applications for NJ marriage licenses must be obtained at the municipal office in the bride's town. If the bride does not live in the state of New Jersey, you can apply at the municipal office of the groom's town. If both the bride and groom are from out of state, apply at the municipal office of the town where the ceremony will take place.

Fees: Due at the time of application is the fee of $28.00.

Requirements: The bride, groom and one witness who is 18 years of age or older and knows the couple.

Some towns will require proof of residency such as a driver's license, lease or tax return.

It is recommended that you apply at least two weeks before the ceremony. You may apply as early as 6 month prior to the wedding. The marriage license is valid for 30 days from the date of issuance.

The individual performing the ceremony should file the license with the registrar in the municipality where the marriage took place within 5 days of the wedding.

Premarital blood tests are no longer necessary in New Jersey.

Actually, this isn''t always true...when we got married, we applied for the license in which we resided, but we got married in a neighboring county (this is all in California). You really do need to check with the laws of each state.

Island Dreams IS correct in stating that you need to make sure your officiant is licensed by the state to perform weddings, or the marriage won''t be legal.

Hey Huisman - I just got an email from one of the vacation/travel websites alerting travelers that soon passports will be required when traveling to Mexico (actually, I think it''s the return to US that is making this requirement, not the entrance to Mexico). I remember that I mentioned in your other thread that you only need DL & birth certificate - but I think you said your fiancee has her passport so she''ll be fine - the expiration coming 6 mos. later won''t be a problem. Just wanted to correct or update my previous statement!

That depends on where you live... You do NOT have to specify a county in some places. north Carolina does not specify a county. We got our ML in one county and got married in another. It is no longer Ness. here. However, as for marrying out of state.. not sure. I would go to the states website and look up the information about the magistrate and marriage liscence rules for that state.

Or call the magistrates or deed of records in your state and they can tell you... or tell you who to comtact anyway!

We just had to get it in the county if we were getting married in A county other than St. Louis City.

Huh... good to know. We have to apply for the license in the county where we''d be married (NE), and I just assumed it was the same everywhere. Of course, it won''t hurt to just go to the county the wedding will be in, but if you can save some driving time...
