Need Perspective on an Awkward Consignment Agreement

@Mrsz1ppy , first I wanted to tell you I've been thinking about you. How are you feeling? Regarding this issue, I don't understand the shipping charges. The vendor should have an account with FedEx for jewelry shipping, like most reputable vendors. I sold on ebth and worthy and never had to pay shipping, either way. I'm also curious why they are missing a license with the state. Are they in compliance?
 
You are so sweet to remember! I am feeling totally enervated, with 4 chemos down, 12 to go. Life is feeling boring, but lacking energy, that’s probably a good thing.

The vendor did have me ship Fed Ex and used Parcel Pro for the insurance. I’m really not sure why this vendor‘s shipping would cost so much more, so I’m glad I was able to find out the cost. I probably would have had the shipping taken out of my proceeds if I hadn’t wanted my pieces back, and at the marked up rate.

The license they are missing is a second hand dealer’s license, for buying directly from the public In NY. So no, according to the consignment agreement, they are not in compliance if they buy from the public. As a consignment, brokering the sale between a member of the public and another member of the public, they are not a second hand dealer, so would be in compliance.

Interestingly, I have asked for Lang’s consignment agreement before I sent my pieces in, and they have a similar clause, where they have the right to buy my articles if they don’t sell in 120 days. Fortunately I am able to strike that clause, paying a small release fee instead.

Grace of JBG charges a release fee, less if your items have been there for 18 months. I’d rather pay that and keep my item, than be forced to sell in a down market.
