What would you do if you were swindled?

Unless that's a terrible photo (which is likely because I don't know if that's an accurate colour representation or not) I'd call that an orangey red to pinky/orange/red sapphire they can be BE treated or not, they are commonly BE treated but not all orange or orangey/red pinky/orange/red sapphires are treated. Sapphires are also commonly heat treated that doesn't automatically mean they also have BE treatments.

It's a terrible photo. It's actually a zoom from a photo. IRL, it's a true red color, blood red, imo. It's actually a very pretty stone. I believed it to be BE treated because he said it's a true red sapphire, not a ruby because it contains no chromium. He said it was red because it was heated. So unless normal heat treatment can turn a non-red sapphire red, or a light red, pink, or orange sapphire deeper red, my conclusion was that it's BE treated. But we already determined we don't know for sure and it's still pretty and fairly price for whatever it is.
