I visited Brian Gavin Diamonds' website and I was a little bit surprised by this page:

particularly the part about the company reserving the right to substitute a similar item of similar value, and the part about binding arbitration.

I wouldn't expect to buy from a PS vendor and not get the exact item I wanted, and I wouldn't expect to have a dispute that got to the point of need to be arbitrated.

The part about how by agreeing to use the website you are agreeing to all of this seemed a little intense to me also.

I'm just curious. Do any of you find any of these condition to be unusual? I haven't looked at other vendors' site to see if they have legal language about using their website, etc. Is this common?

Actually, right before my BGD band was about to ship, Lesley informed me that they had upgraded the stones in the band. I had requested H/I SI1 stones to lower the cost (and because my ering diamond is a J and I thought more colorless stones would cause it to appear darker). She said they must not have had any H/I SI1 melee when they made the band so I received higher quality diamonds for a lower price.

So in that case, I'm all for substitutions! :wink2:
 
I'm glad it didn't have to go to arbitration! ;))
 
I suggest looking at the other vendor sites yourself and comparing.
