Just some initial thoughts - I am not sure you have any grounds to really stand on for a credit card dispute. The diamond is the one your fiance bought - slanted, included and all. He picked it out and it matches the IGI certificate which is what came with the stone. What it says on the receipt/invoice is wrong but that was human error that could have been corrected assuming your fiance was given the IGI certificate and bought based on the IGI certificate.

In general, settings are made for specific shaped stones and you can't just put anything in there. For that setting, I think you can get a round stone in there or another square stone.

I honestly don't think the store owns you anything other than a corrected invoice but that's just my two cents. You got what you bought. The diamond looks slanted because it is (and not a bad setting job). You see inclusions because it is not an eye clean SI1 - known to be a possibility. Most diamonds are pre-owned but gets re-papered and sold as new - this is pretty common practice.


This is what I'm thinking too, honestly...

I really don't think trying to force an oval (or any shape without a L/W ratio of ~1:1) into that setting is going to end well - not without having an excellent craftsman re-structure the head, and that sort of alteration won't come cheap.
 
That's what we concluded also. The store is taking back the ring & we get to start over. Now the problem is them finding a decent oval. They brought in 2 & they weren't good enough, the one had a window above and below a big bowtie. They haven't called to say they brought in anymore & it's been a week so I am calling after work. I am losing faith that they will find an oval to my standards but I don't really want to pick a different shape. I'd search for one myself but I don't know how much their markup is going to be.

I'd see if you can find one from another vendor-have them buy it for you via wire price and agree to pay them 300-500$ more for the stone.

That way you know you're getting a good one and they aren't calling in all these stones and you keep getting duds. HUGS!
 
I too, think you should look online for a decent oval to suggest. If they are like my situation was, they will quote you what their price is for the same stone you find online, if they can get it. I doubt that there will only be a $500 markup or that they will let you decide how they pay for it, since they probably have their own rules they have to follow. I paid a 25% premium over the online price. If I didn't like the price I could wait for them to bring in more stones on their own. Mine was a replacement stone using their lifetime warranty when mine chipped, that they allowed me to upgrade, so I was locked in. (A stone the same size and quality as the damaged one, would have been free) I still made out ok, since I didn't have to go through my insurance for it, and I am still covered for any damage to this stone if it chips or cracks, by the retailer. It's tricky trying to meet in the middle between B/M & online, when trying to find a stone, but it can be done. It's just more expensive. But when you are locked in to a place, at least you have some control over your own stone search.

Didn't they offer to refund you $5,000 for the stone?
