In the US, generally, it is a conditional gift- i.e. conditioned up on marriage, unless given on another occasion such as a birthday or Christmas, where it could be considered a general gift without the condition.

The giver receives the ring back if the condition does not happen as agreed. Once married, the ring is considered the personal property of the recipient in almost all situations.
