I thought that you could only be tried the one time for a crime and if you were found "not guilty" there was no going back to do it again?
The State cannot appeal. Once someone is acquitted, it's over forever because of our constitutional right preventing a person from being placed in double jeopardy. This is why the prosecution has the ability to make an interlocutory appeal (an appeal in the middle of the proceedings to decide an issue of law).
