1. One has to actually leave first (as opposed to repeatedly threatening same).

Rodentman asked me to deactivate his membership, which I did.

Since he does this on such a regular basis, I wonder if any of the administrators, at any of the forums, will eventually choose not to have him back.

I hope they re-activate his account if he so chooses.

I'm a little hurt that I didn't get one of the PMs.

So do I. In fact I wish no one would listen to him when he asks to be uninstated.

Leonid, maybe I'm missing something in the technical details.

You regretfully announced on the other thread at 2:09 pm central time that he'd requested deactivation and that you had done so. If his account was deactivated, then how it is that he's still able at 5:37 p.m. to send a "colorful" PM to Hest?

Another musing: The PS rules prohibit anyone from having multiple users. Given that you have "deactivated" his member status, doesn't that mean it is possible for him to create an entirely different user without violating that policy?

I switched time zone from PST to EST at that time. The new server is located in Silicon Valley but I'm in Toronto. (I hope you guys don't mind.) So here is your 3 hours difference.

If he will register and start posting under different name it would be agains the forum rules. However, I guess, there is no need for that since he wasn't banned.

Am I supposed to be getting emails when someone responds to a thread in steamroom? I am not even though I know I ticked the box.

Why does DT now have a forum called "Singapore"?

I just noticed that their "link of the moment" on the opening page is labeled "ICEMAN" but links to DirtCheapDiamonds. I wonder if it's an intentional slap at Midwest Gems?

A new Iceman is also the newest user. It looks like Josh is taking over Ice's 8000 posts.

I thought that using "Iceman", at least for someone in the trade like Jim, was illegal.

Deb

I think that *Iceman* is trademarked and if so, things could get a little ugly.

Gee, terrible shame if it did...
12.gif

It looks like it's a new poster, "IceMan" and it is DCD...

I know nothing about trademarks however.

Where is this located? I couldn't find it when I searched DT.

Babs, I didn't see it on the front page, so I checked members listing, sure enough "Iceman"'s www page is Dirtcheap diamonds, and his icq is dirtcheap.

win

Win,
I suspect the *real* Iceman is not going to be pleased. I believe he did have his name trademarked. It will be interesting to see how this plays out.

Gee, had I known you'd feel left out, I'd have gladly forwarded mine to you instead of deleting it unread.

.......

Maybe Hest can share hers with you.....LOL

According to the USPTO database, there are two active applications for "Iceman" right now (though no trademark registration has been issued yet):

1) Solid 21 Incorporated Corp., Los Angeles CA

2) Corey J. England Corp., Moline IL

I have no idea if either is Iceman. However, another diamond company using "Iceman" in a jewelry forum could well be infringing on the trademark if it's being used to solicit business.

Note that you do not have to register a trademark with the USPTO for it to be valid. You merely have to use it consistently in commerce. You do have to register to file an infringement suit, though.

Corey is *our* Iceman.

Deb

Then someone had best let him know about this.

I did. Not that I visited Diamond Talk. But I told him (via e-mail) that there was discussion of this on Pricescope. My guess is that if it truly is Dirt Cheap Diamonds that is using the name "Iceman", though, that Jim is just yanking Ice's chain. They've known each other forever. It has to be a practical joke.

Yes the name is trademarked and I get royalties from its usage and parcel usage's. I contacted Dirt and he is going to have it
removed, I also get the pleasure of emailing DT about the case, Im praying they don't comply
2.gif
I emailed DT in May about a
similar one they had Icemann with no return so
1.gif
. The attorney I use is full bore on this stuff and has retrieved lots of money for
me

We have some big dogs we are going after next week when I go meet with him

Oh, I'd buy tickets for this show! Go get 'em, Iceman!!!
appl.gif

Ice,
Is emailing DT enough? I thought one had to send a certified letter telling them to cease.

A certified letter is a good idea since it gives you proof of receipt, but it's not required. The law only requires some form of notice.

Here is the scope, Solid 21 you can see applied for their trademark 1 month after I did. What hung it up is they were issued a
lower number. That's were the attorney jumped in and made them aware of their mistake. So, they issued solid 21 the letter of
to bad. Things are almost over. Then we go after Solid 21, he is the big dog in California that blows he is the Iceman to all the
Movie stars. He has been on VH1 and News week ect. Big operation, but I applied first
1.gif
Im also receiving royalties , Just a
few things to patch up next week. What it boils down to is I applied and have shown usage before and longer then solid 21.
Forbes Magazine is on our list at the next meeting also. Along with DT who refuses to return my emails and that is fine with me,
I was hoping for that. Trade marks are a big deal, I learned a lot from Eightstar talking to Jason

Interesting that Gilbert, who went on such a rant about his intellectual property rights when Rocdoc set up DCC, doesn't seem to care about those of others.

Ice, I applaud you for taking your IP rights seriously. Too many people these days don't, and if you ignore infringement, it can get very hard to enforce your rights later on, especially with trademarks. If you let them get generic before trying to enforce them, you've probably lost already.
